Terms of Service

Effective date: June 1, 2026

These Terms of Service (the "Terms") govern access to and use of the Posted.art platform, including the website, web application, mobile-first application experience, hosted Postcard pages, smart-contract-enabled ownership flows, and related services, features, content, and functionality that link to or reference these Terms (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.


1. Overview of the Platform

Posted.art is a mobile-first platform for visual digital content built around three connected services (the "Services"):

  • Postcards: a hosted digital composition and sharing product
  • Create & Earn: a creator submission and participation product
  • Art Certificates: an ownership layer represented through non-fungible tokens ("NFTs")

The Platform uses a shared content library. The same visual content can be:

  • browsed publicly
  • used in a Postcard
  • submitted through Create & Earn
  • offered for acquisition as an Art Certificate

Posted.art separates content usage, content creation, and content ownership. Using content in a Postcard does not require ownership of that content as an NFT.


2. Definitions

"Art Certificate" means an NFT representing ownership of a supported item from the Platform's content library, subject to the scope and limitations described in these Terms.

"Content" means visual, audio, textual, compositional, metadata, and other materials made available on or through the Platform, including images, videos, music clips, messages, gift-related media, and Creator-submitted materials.

"Creator" means a user or Posted.art that submits, provides, or makes Content available through the Platform.

"Postcard" means a hosted digital composition created through the Platform that combines Content with a message and optional music or gift-related elements.

"Services" means the Postcards, Create & Earn, and Art Certificates services, together with any related Platform features.

"User Content" means any Content, message, media, metadata, submission, feedback, or material that you upload, submit, transmit, create, store, or otherwise make available through the Platform.

"Wallet" means a blockchain wallet, address, application, account interface, or similar tool that enables a user to authenticate, sign messages, or transact with blockchain networks and the Platform.

"You" and "your" mean the person or entity accessing or using the Platform.


3. Access and Wallet

The Platform supports public browsing, but certain features require authenticated access through a supported Wallet or account authentication provider.

Where Wallet-linked access is used, you must connect a supported Wallet and sign an authentication message to verify control of that Wallet. Certain Platform experiences may instead use supported account authentication providers. That authentication message is not, by itself, a blockchain transaction.

You are solely responsible for your Wallet, private keys, seed phrases, devices, credentials, and all activity conducted through your Wallet. Posted.art does not control or custody your Wallet and cannot recover access to it or reverse blockchain transactions.


4. Postcards

Postcards are temporary hosted items made available through the Platform. Certain Platform experiences may allow users to locally prepare or schedule Postcards for future sending or publication. Postcards do not represent ownership of Content and are not NFTs. Creating, sending, receiving, viewing, or sharing a Postcard does not transfer copyright or other intellectual property rights in any Content.

Postcards are made available through Platform-controlled hosting for a limited period and may be removed through expiration, deletion, infrastructure failure, or other operational events. Once removed, expired, or deleted, a Postcard may no longer be available through the Platform.

You are solely responsible for the messages, media, and other materials you include in a Postcard.


5. Create & Earn

Create & Earn allows Creators to submit Content to Posted.art for review and possible inclusion in the Platform.

Submission of Content does not guarantee acceptance, publication, continued availability, sale eligibility, or economic results.

Posted.art may review, accept, reject, limit, delay, suspend, remove, or disable submitted Content at any time, with or without notice, in its discretion.

If submitted Content is approved, Posted.art may make that Content available through one or more Platform features, including display, Postcards, Art Certificates, and related Platform use.


6. Art Certificates

Art Certificates are blockchain-based ownership records associated with selected Content from the Platform. Art Certificates are optional, separate from Postcard usage, and depend on third-party Wallets, smart contracts, blockchains, and related services.

For primary Art Certificate sales executed through the Platform, the Creator receives 90% of the sale price and the Platform receives 10%, as enforced by the applicable smart contract logic. Secondary royalty mechanics, including any default royalty configuration reflected in the applicable smart contract, depend on the relevant marketplace or protocol to recognize and apply them, and are not separately provided or guaranteed by Posted.art under these Terms.

Ownership of an Art Certificate does not transfer copyright, trademark rights, moral rights, or other intellectual property rights in the associated Content.

Acquiring an Art Certificate gives you only a limited, non-exclusive license to use the associated Content for your own personal, non-commercial display and enjoyment, solely to the extent such use is consistent with the nature of the Art Certificate and these Terms. For clarity, this limitation applies to the associated Content and does not by itself prohibit transfer or sale of the Art Certificate where such transfer is technically supported.

Art Certificates are subject to applicable smart-contract rules, technical dependencies, metadata behavior, and network-specific requirements, which can include edition limits, royalty logic, and burn functionality. Posted.art does not guarantee that every wallet, marketplace, interface, or third-party service will correctly display or support an Art Certificate.


7. Intellectual Property

The Platform, including its design, interfaces, software, branding, trademarks, logos, compilations, databases, text, graphics, and Platform-provided Content, is owned by Posted.art or its licensors and is protected by intellectual property and other applicable laws.

Except as expressly permitted by these Terms, you may not:

  • copy, reproduce, distribute, publicly display, modify, adapt, translate, create derivative works from, sell, license, or exploit the Platform or Platform Content
  • remove or alter copyright, trademark, or proprietary notices
  • use the Platform or Platform Content for commercial purposes without prior written permission

All rights not expressly granted are reserved.


8. Content License

As between you and Posted.art, and subject to the rights you grant under these Terms, you retain whatever ownership rights you may have in your User Content.

By uploading, submitting, storing, minting, transmitting, composing, publishing, or otherwise making User Content available through the Platform, you grant Posted.art a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, adapt, display, perform, distribute, transmit, index, cache, promote, market, moderate, and otherwise use that User Content as reasonably necessary to:

  • operate the Platform
  • provide the Services
  • create, host, and display Postcards
  • review creator submissions
  • prepare, display, and distribute associated metadata
  • offer and support Art Certificates
  • improve, secure, and troubleshoot the Platform
  • comply with law and enforce these Terms
  • promote the Platform and the availability of Content on the Platform

This license includes the right to use service providers and infrastructure partners to provide the foregoing functions.

You represent and warrant that:

  • you own or control the necessary rights in your User Content
  • your User Content and your use of the Platform do not infringe, misappropriate, or violate any third-party rights
  • your User Content complies with these Terms and applicable law
  • any person identifiable in your User Content, where relevant, has provided any permissions or consents required for the intended use

You are solely responsible for your User Content and for the consequences of submitting or making it available through the Platform.


9. Acceptable Use and Prohibited Conduct

You may not use the Platform to, or in a way that attempts to:

  • violate any applicable law, regulation, or third-party right
  • upload, submit, or distribute infringing, misleading, fraudulent, defamatory, abusive, hateful, obscene, or unlawful material
  • submit Content you do not have the right to use, license, or commercialize
  • impersonate another person or misrepresent your affiliation, authorship, rights, or authority
  • distribute malware, viruses, harmful code, or other disruptive materials
  • interfere with, damage, disable, overburden, or impair the Platform or related infrastructure
  • scrape, crawl, harvest, mirror, index, or extract Platform data except as expressly permitted
  • bypass, disable, or interfere with security features, access controls, rate limits, moderation tools, or technical restrictions
  • use bots or automation in a way that abuses the Platform
  • manipulate pricing, creator attribution, transaction flows, metadata, or platform metrics
  • use the Platform to harass, threaten, exploit, or harm others
  • submit spam or unauthorized promotions
  • use the Platform in a way that exposes Posted.art or its users to legal, regulatory, or security risk

Posted.art may investigate suspected violations and may remove Content, suspend access, block transactions, or take any other action permitted under these Terms.


10. Payments, Pricing, Fees, Taxes, and Refunds

Prices are displayed in local fiat currencies based on the user's region for presentation purposes, and settlement occurs using the payment asset presented in the applicable flow.

Current supported payment networks and assets are listed in the FAQ. Posted.art uses server-authoritative preparation of pricing and transaction data where applicable. Displayed prices, supported networks, supported assets, available purchase options, and related product settings may change at any time before confirmation.

Depending on the Service, payments involve one or more of the following:

  • off-chain product fulfillment
  • on-chain payment execution
  • on-chain minting
  • smart-contract-based sale logic
  • third-party network fees, gas fees, or service fees

You are solely responsible for:

  • reviewing transaction details before approval
  • paying applicable gas fees, network fees, taxes, duties, and similar charges
  • ensuring that your Wallet and network selection are correct

You are solely responsible for determining, collecting, reporting, and paying any taxes, duties, levies, or similar governmental charges that may apply to your use of the Platform, your purchases, your sales, or your receipt of any Creator revenue.

Unless otherwise required by applicable law or expressly stated by Posted.art in writing:

  • all completed payments are final
  • blockchain transactions are irreversible
  • failed, delayed, dropped, or underpriced transactions may not complete
  • Posted.art is not responsible for losses caused by wallet error, network congestion, validator behavior, chain reorganization, third-party service malfunction, or user mistake

Creator revenue distributions for primary Art Certificate sales executed through the Platform are processed through the applicable smart contract and are irreversible once executed on-chain. The applicable smart contract logic, including the Creator's 90% share and the Platform's 10% share, is immutable after first mint where the contract so provides, and related payments must therefore be treated as final. Secondary royalty mechanics, including any default royalty configuration reflected in the applicable smart contract, depend on the relevant marketplace or protocol to recognize and apply them.


11. Storage, Availability, and Third-Party Services

The Platform relies on third-party infrastructure, including blockchain networks, wallet providers, hosting providers, storage systems, indexing services, domain and DNS services, content delivery networks, and other technology providers.

Posted.art does not control and is not responsible for the acts, omissions, uptime, security, policies, or technical behavior of third-party services.

Posted.art does not guarantee:

  • uninterrupted or error-free Platform availability
  • continued support for any particular blockchain, wallet, file format, or third-party service
  • immediate or accurate indexing of Art Certificates in third-party wallets or interfaces
  • permanent availability of any Content, metadata, Postcard, or media file through the Platform interface

Postcards are temporary hosted items. Art Certificate media is stored using persistent or decentralized storage mechanisms, but Posted.art does not guarantee perpetual retrievability, continued gateway support, or uninterrupted access through the Platform.


12. Copyright Complaints and Infringement Notices

Posted.art respects intellectual property rights and may remove, disable, restrict, or preserve allegedly infringing material in response to complaints, legal demands, or risk assessments.

If you believe Content on the Platform infringes your copyright or other intellectual property rights, you may send a notice using the contact details in the FAQ, with enough information for Posted.art to identify the material, the claimed rights, and the basis of your complaint. Posted.art will review the notice and, where appropriate, remove or disable access to the identified Content within a commercially reasonable time.


13. Suspension, Removal, and Termination

Posted.art may, at any time and with or without notice, remove, disable, suspend, or limit access to platform-controlled Content, features, or functionality, including:

  • Postcards
  • Creator submissions
  • hosted media
  • Platform purchase flows
  • Platform display flows
  • any feature or portion of the Services

Posted.art may take these actions where Posted.art determines that Content or use of the Platform:

  • violates these Terms
  • infringes rights or violates law
  • creates legal, security, technical, or reputational risk
  • depends on a third-party service that is unavailable or compromised
  • requires removal, restriction, or suspension for operational reasons

You may stop using the Platform at any time.

Because the Platform relies on Wallets, blockchains, and other decentralized or third-party systems, Posted.art cannot disable a Wallet, delete blockchain records, reverse on-chain transactions, or recover Wallet assets. Posted.art also does not guarantee continued access to previously available materials.

Sections of these Terms that by their nature should survive removal, suspension, or termination will survive, including sections relating to intellectual property, licenses, payment obligations, risk allocation, disclaimers, limitations of liability, indemnification, and enforcement.


14. Indemnification

You will defend, indemnify, and hold harmless Posted.art and its affiliates, service providers, licensors, and partners, and their respective personnel, from and against any claims, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys' fees arising out of or related to:

  • your access to or use of the Platform
  • your User Content or transactions
  • your violation of these Terms
  • your violation of applicable law
  • your infringement or misappropriation of any third-party rights

Posted.art may assume exclusive control of the defense of any matter subject to indemnification by you, and you agree to cooperate with that defense.


15. Risks

You understand and accept that use of the Platform involves the following risks:

  • Wallet loss, theft, compromise, or user error
  • blockchain congestion, forks, reorgs, downtime, or failure
  • smart contract bugs, exploits, or unintended behavior
  • volatility in digital asset prices
  • failed or delayed transactions
  • irreversible transactions
  • metadata or media access issues
  • third-party service outages
  • regulatory or legal changes
  • inaccurate or delayed indexing or display by wallets or third-party services

You are solely responsible for evaluating the risks of using the Platform, sending Postcards, submitting Content, and acquiring or transferring Art Certificates.

Nothing on the Platform constitutes investment, legal, tax, accounting, or financial advice.


16. Privacy

Your use of the Platform is subject to the Privacy Policy.


17. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTED.ART DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, POSTED.ART DOES NOT WARRANT THAT:

  • the Platform will be uninterrupted, secure, error-free, or continuously available
  • any Content, Postcard, Art Certificate, metadata, or media will remain available, retrievable, accurate, complete, lawful, or non-infringing
  • any blockchain transaction, wallet, smart contract, gateway, host, or third-party service will execute, display, index, settle, remain supported, or operate as expected
  • any Art Certificate will have present or future value

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTED.ART AND ITS AFFILIATES, SERVICE PROVIDERS, LICENSORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, DIGITAL ASSETS, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE PLATFORM OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF POSTED.ART FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO POSTED.ART FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE CLAIM AROSE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS OR LIABILITY LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.


19. Changes

Posted.art may modify the Platform, the Services, supported networks, technical requirements, pricing presentation, product flows, policies, or these Terms at any time.

Updated Terms become effective when posted, unless a later date is stated. By continuing to access or use the Platform after updated Terms become effective, you agree to the revised Terms.

If you do not agree to revised Terms, you must stop using the Platform.


20. Miscellaneous

These Terms, together with any policies and documents incorporated by reference, form the entire agreement between you and Posted.art regarding the Platform.

Failure by Posted.art to enforce any provision of these Terms is not a waiver of that provision or any other provision.

Unless and until Posted.art is operated through a separate legal entity, these Terms are between you and Posted.art, which is operated in a personal capacity.
